Synergy Website Terms

These Website Terms govern access to and use of Synergy's public website and general public information.

Separate Customer Terms, Customer Conduct Requirements, Provider Terms, Provider Conduct Requirements and Provider Commercial Terms apply where relevant to those roles and functions.

1. About Synergy

Synergy is a private Australian community services directory.

Synergy helps local people find capable local people.

Synergy enables the introduction. The Customer and Provider manage the work and make their own arrangements.

2. Public website information

Public pages explain Synergy, how the service works, available Service Categories, Provider Listing options, accessibility, support, privacy and other general information.

Provider Profiles, Provider search results and other protected private-directory information are not public website content.

3. Customer and Provider accounts

Creating or using a Customer or Provider role may require you to accept additional terms and conduct requirements.

Provider Listing purchases are also subject to applicable Provider Commercial Terms and purchase disclosures.

These Website Terms do not replace those role-specific terms.

4. Synergy is a directory, not the provider of the work

Unless Synergy expressly states otherwise for a particular Synergy service, Synergy is not the person performing services advertised by a Provider.

Synergy does not employ Providers, allocate jobs, supervise work, manage bookings, determine the scope of work, negotiate the price of work, receive Customer payment for work, hold work-related funds or make payouts to Providers for Customer work.

A Customer and Provider who decide to proceed are responsible for their arrangements with each other.

5. Provider information

Provider information is supplied by or on behalf of the Provider and may be subject to Synergy's approved Profile and Listing review processes.

Publication of a Provider Profile does not mean Synergy guarantees that the Provider is suitable for every task.

Unless Synergy expressly states that a particular fact has been independently verified, users must not assume that Synergy has independently verified a Provider's qualifications, licences, registrations, insurance, experience, competence or lawful scope of work.

6. Customer responsibility

Customers should make checks appropriate to the service they require before engaging a Provider.

Depending on the service, this may include discussing experience, price, timing, insurance, qualifications, licences, registrations, references, safety requirements and the proposed scope of work.

Synergy does not determine whether a particular future task requires a licence or whether a Provider is legally permitted to perform that task.

7. Provider responsibility

Providers are responsible for the accuracy of information they supply to Synergy and for ensuring that services they offer and work they accept are lawful.

Providers are responsible for holding any licence, registration, permit, qualification, approval or insurance legally required for work they undertake.

8. No guarantee of enquiries or work

A Provider Listing gives an eligible Provider Profile the applicable directory-publication entitlement.

Synergy does not guarantee that a Provider will receive any enquiry, customer, job, income or particular search position.

9. Emergencies

Synergy is not an emergency service.

Do not use Synergy where urgent police, fire, ambulance or other emergency assistance is required. Use the appropriate emergency service instead.

11. Intellectual property

Synergy website design, software, branding, written content and other material may be protected by copyright, trade mark and other intellectual-property laws.

You may use public Synergy information for ordinary personal and lawful purposes. You must not reproduce or commercially exploit Synergy material in a way that infringes applicable rights.

Provider-supplied content remains subject to the rights and permissions applicable to that content.

12. Links and external services

Synergy may use or link to external services. External services are governed by their own terms and privacy practices where applicable.

A link does not by itself mean Synergy endorses every statement, product or service available through the external site.

13. Availability and changes

Synergy may need to interrupt or change website functions for maintenance, security, legal compliance or service operation.

Synergy does not promise uninterrupted or error-free availability. Where Synergy supplies a service to a consumer, this clause does not remove any right or guarantee that cannot lawfully be excluded.

14. Information accuracy

Synergy aims to keep its own public information accurate and current.

If Synergy becomes aware that material public information is incorrect, it may correct or update that information.

User-supplied content may change and Synergy cannot guarantee that every statement supplied by another user is complete or current.

15. Australian Consumer Law

Nothing in these Website Terms excludes, restricts or modifies any consumer guarantee, right, remedy or other protection under the Australian Consumer Law or another law that cannot lawfully be excluded, restricted or modified.

Where Australian Consumer Law protections apply to a service supplied by Synergy, those protections continue to apply despite anything else in these Website Terms.

16. Responsibility for Customer–Provider arrangements

Synergy is not a party to an agreement for work made directly between a Customer and Provider merely because the parties found each other through Synergy.

The Customer and Provider are responsible for agreeing and managing matters such as scope, quotation, price, timing, materials, access, safety, payment and completion of their work.

Nothing in this section excludes responsibility that Synergy cannot lawfully exclude for Synergy's own conduct or services.

17. Reports and moderation

Synergy may provide mechanisms for reporting suspected platform misuse, misleading information, privacy concerns, unsafe conduct and other matters within its approved moderation scope.

Synergy may review reports and take action concerning access, Profiles or Listings where permitted by the applicable Synergy terms and policies.

Synergy does not ordinarily adjudicate private disputes about workmanship, price, scheduling, payment or contractual performance between a Customer and Provider.

18. Privacy

Synergy handles personal information as described in the Synergy Privacy Policy.

19. Changes to these Website Terms

Synergy may update these Website Terms when the public website, applicable law or Synergy's approved operating arrangements change.

The latest published date appears at the top of this page.

Changes to separate Customer Terms, Provider Terms or Provider Commercial Terms are governed by their own versioning and acceptance processes and are not made effective merely by changing these Website Terms.

20. Australian law

These Website Terms are governed by applicable Australian law.

Nothing in these Website Terms limits a right to bring a matter before a court, tribunal, regulator or other body where Australian law gives that right.
